On March 13, 2024, the European Parliament passed the historic AI Act, setting a global precedent for regulating artificial intelligence (AI). The legislation aims to balance innovation with stringent safeguards, ensuring the safe and ethical development of AI technologies.

Historic Legislative Milestone: The AI Act received overwhelming support from the European Parliament, with 523 lawmakers voting in favor and only 46 against. This landmark decision marks the culmination of efforts that began in 2021, aiming to establish a robust regulatory framework to manage the rapid advancements in AI. The legislation is expected to receive formal endorsement from the EU’s 27 member states in April, with official publication anticipated by May or June.

Innovative yet Cautious Approach: According to Brando Benifei, an Italian lawmaker who co-authored the bill with Romanian MEP Dragos Tudorache, the AI Act represents a “historic day” for AI regulation. Benifei emphasized the importance of a “safe and human-centric development of AI,” while Tudorache highlighted the delicate balance between fostering innovation and ensuring protection. Their sentiments were echoed by Thierry Breton, the EU’s internal market commissioner, who lauded the EU’s position as a global leader in trustworthy AI.

 

Risk-Based Regulatory Framework: The AI Act adopts a risk-based approach, imposing stricter regulations on systems deemed to carry higher risks. High-risk AI providers must conduct comprehensive risk assessments and ensure compliance before their products reach the market. For instance, the legislation bans AI applications used for predictive policing and prohibits systems that infer personal attributes such as race, religion, or sexual orientation from biometric data. Furthermore, real-time facial recognition in public spaces is generally banned, except under specific law enforcement scenarios requiring judicial approval.



Balancing Interests Amid Intense Lobbying: The legislation has faced intense lobbying from both European startups like Mistral AI and Aleph Alpha and US tech giants such as Google and Microsoft. Watchdogs have warned that corporate lobbying could potentially dilute the act’s provisions. However, Commissioner Breton assured that the EU has withstood these pressures, maintaining a balanced, risk-based, and future-proof regulation.



Compliance and Penalties: The new rules will take effect 12 months after official publication, with most provisions becoming mandatory within two years. Companies that violate the regulations face substantial fines ranging from €7.5 million to €35 million, depending on the severity of the infringement and the company’s size.
